Learn more about this event

The Emergency Medical Treatment and Labor Act (EMTALA) details hospital and physician requirements for providing stabilizing emergency medical care to patients which present to the hospital emergency department.

The presentation will cover current requirements from the Centers of Medicare and Medicaid Services (CMS) as well as provide a series of questions and answers to help with examples for practical approaches and discussion.

Learning Objectives/Agenda

• If you transfer a patient, are you committing an EMTALA violation?
• Can a non-physician accept or reject transfers on the hospital’s behalf?
• Under EMTALA can you transfer an unstable patient?
• Does EMTALA apply to an admitted patient who has an emergency medical condition?
• Does EMTALA apply to hospital owned ambulances, not on hospital property?

Why is this topic important?

Monetary penalties are enforced by the Office of the Inspector General (OIG) for both hospitals and physicians who violate the EMTALA.
