5A:Understanding the (not so) Voluntary Disclosure Rule

This session will address the voluntary disclosure and refund requirements imposed under the FERA and ACA amendments to the False Claims Act. Each element of the rule will be addressed in detail to include when the 60 day reporting clock begins to run, what constitutes credible information of a potential overpayment, and what constitutes reasonable diligence once credible information of an overpayment is received. This session will also address how audit findings should be drafted to preclude inappropriate disclosure liability, risks and penalties for non-compliance and the submission requirements when an overpayment is discovered.

5B:Compliance Concerns in Risk Adjustment

On March 30, 2020 the DOJ initiated a lawsuit against Anthem for allegedly submitting inaccurate Medicare Advantage chart reviews to CMS for risk adjustment, stating that “Anthem knowingly disregarded its duty to ensure the accuracy of the risk adjustment diagnosis data that it submitted to [CMS] for hundreds of thousands of Medicare beneficiaries." This presentation provides participants with up-to-date useful information and practical insights into the Anthem/DOJ dispute, with tools that they can use to improve RA coding for their clients and practices.

Making sure your compliance program meets all the recommendations for an effective compliance program is important but making sure the compliance program has the proper oversight from a governing board or compliance committee is paramount to its success. If fact, HHS OIG has written that "Boards are expected to put forth a meaningful effort to review the adequacy of existing compliance systems and functions." In other words, some aspects of an effective compliance program are not necessarily under the direct control of a Chief Compliance Officer, but rather the Board. This session will cover compliance program oversight expectations of Boards, best practices in roles and responsibilities as they relate to the Board and lessons learned from Boards that did not meet their compliance oversight responsibilities.
