I know that if the pt is seen in the office and then seen in the ER and admitted, the office visit would be included in the admission code. But what if the pt isn't admitted? Can they be billed for the same date of service?

Yes, if the patient is not admitted, then the E/M and the ER visit can be billed on the same day.
