Wiki Telehealth CPT 99441-99443 (telephone only) while In-Patient

Can someone clarify the telehealth billing rules for Texas Medicaid for CPT codes 99441-99443? Is is correct to bill these codes when a patient is inpatient to Texas Medicaid with POS (2) & Modifier (95)? We have been receiving denials from Texas Medicaid for these codes. Denial message: Physicians may not bill an E&M code for an office visit while the patient is under going an inpatient hospital stay.
