If a CNP and Attending both document on a consult and the attending attests the note, who should get billing credit for the charge?

Here is an example:

If the attending's documentation supports a level 2 and the CNP's supports a level 3, if we bill the level 3 for CNP, is that considered up-coding?

A few questions...When you stating CNP I assume you are referring to the Community Nurse Practitioner? Is the Nurse Practitioner completing an internship or residency program? Normally a NP does not require an attestation statement.
 
Certified Nurse Practitioner. Yes, we know they don't require a teaching statement but in the event there is one.....we wanted to know what others are doing. Thanks!
