If a physician perform a procedure and stops because he can not continue due to a weak vein and he decides to do another procedure. Can he bill for both procedure but append a 53 modifier to the procedure he did not complete? Or should he bill one procedure?

You can bill either a discontinued procedure or you can bill the completed one, but you cannot bill both discontinued and completed at the same time. Depending on documentation you might be able to append a 22 modifier to the completed procedure.
