Since Medicare will be going back to the original telehealth requirements after the first of the year our providers were wondering if they could still offer a telehealth service to patient's as a self pay service.
Example scenario would be a patient with commercial insurance needs to come in every three months to get refills for a controlled medication. The patient wants to do a telehealth visit for their refills. The patient consents to not billing their commercial insurance for this visit and will pay a self pay rate for this service. Is this something we can still offer with patient consent? We understand we would not be able to offer this to anyone with Medicare or Medicaid. Would it be ethical to offer this service for patient's with commercial insurance.

Thank you for your advice!

I would suggest reviewing your commercial contracts.
