Wiki Physician billing of a E&M note created by a PA what are the rules

If someone could help me out I have a Physician that wants to bill a new pt visit using the note the PA created. The PA will not be billing and i need to know
can he do that with an attestation?
 
Under CMS rules, that is not allowed - a physician can only bill for the services of a PA if the 'incident to' rules are met or if it is a shared visit, but neither of those are applicable to a new patient visit. Other payers could have policies that allow this, usually when the payer does not credential physician assistants, but I'd recommend finding that in writing before submitting the claim under a different provider than the one who performed the service.
