My understanding is Medicare will deny a claim filed on the same day the patient dies.
However, I have an E/M that occured earlier in day.

Is there anything I can do about the claim?

I would submit your claim. Claims pay all the time for services on a patient's date of death, especially in the hospital setting. The only time this was a problem was when the date of death was reported incorrectly to the Social Security Administration (data entry error) and the deceased patient's family had to correct it before my claims would be paid, but they were eventually corrected. Your provider did the work, you should file the claim.
