Can a doctor charge a consutlantion visit on a new patient that is on worker compensation that was referred by the employer?

That does not meet the criteria of a consultation unless the request was made my the employer's insurer. An employer is not an "appropriate source" for making a request for a consultation. This would be coded as a new patient visit.
 
so if the employers insurer requested a consultation of the doctor then you can bill it as a consultantion?

An insurance company is listed in the CPT book as an "appropriate source" for requesting a consultation.
