We have a family practice with a general surgeon. If the family practice doctor refers his patient to the general surgeon, the general surgeon should still be able to charge this as a new patient correct? The billing is being submitted under his individual NPI.

Yes, different specialty, if the patient has not been seen by the surgeon for any face to face services in the past three years.
