Wiki New TIN - can we bill "new" patients?

Our group of physicians recently left a practice and started their own. They have many patients that have followed them to the new office. We have a new tax ID and are a separate practice. Even though some of these patients have been seen at the "old" office are we able to charge as new patients? We are having to do new work-ups (scanning charts, new history, etc.) so I'm wondering if we should be seeing them as "new" patients to this practice.

Would you mind sharing your answer? I've always thought you could bill as NP in the situation you describe. I was told within the last year that you can't--that New vs Est is now dictated by NPI, not TIN. What did you find out, and how did you confirm your answer or where did you find your info?
