For non-DME certified locations, is it permissible for an occupational therapist to use only 97760/97763 for the time spent on the fabrication, education, fitting, and training of an orthosis provided to the patient, rather than using an L code with an ABN for the fabrication of the orthosis and 97760/97763 for the fitting, education, and training?

In other words, could a non-Medicare DME credentialed clinic code 97760 for the entire process of making a WHFO C/F L3807, including fabrication (45 minutes) and education/training (15 minutes), totaling 4 units (without submitting the L code or an ABN)?

Or, should the occupational therapist instead code L3807 for the fabrication time (45 minutes, 1 unit), provide an ABN to the patient because the clinic is not a DMEPOS supplier, and separately code 97760 for fitting, education, and training (15 minutes, 1 unit)?
