I am billing for an ENT who has audiologists within the practice. The patient was seen by an audiologist on 10/3/09 for a testing svce & then the patient saw the ENT for a new patient visit on 2/12/10. The claim was denied because they patient is not a new patient however the provider refuses to believe this since he did not see the patient before 2/12/10 & the service that was provided in 2009 was not an E&M service. Who is correct? If I am is there something I can pull to show the provider in black & white why I am correct??

Where the services that the audiologist performed billed under the doctor? If they were then the patient is not new. If you billed under the audiologist then the doctor's visit would be new since this is his first face to face encounter with the patient. Hope this helps!
