Is it possible to submit an E&M code with 57 modifier or will it get bundled into the surgery code(s) that occurred the day after E&M?

The patient was in the hospital and evaluated for deeply infected toe ulcer which warranted amputation the following day. The surgeon wants to charge the E&M code AND the toe amputation.

You can use modifier 57 to take the visit the day before out of global if that is when the decision for surgery was made . The surgery being done must be a "major" procedure, meaning it has 90 days global.
