It states in the guidelines if the patient is receiving "active treatment" with examples of active treatment being emergency room encounter, surgery, and evaluation and TREATMENT by a new provider.That would be the question was there active treatment or just follow up? If the patient came in just for follow up to have the eye looked at to make sure it has healed and there is nothing else wrong with the eye that requires treatment it would be a subsequent encounter even though the patient is new to the provider.
