If a mid-level provider sees a patient for what is supposed to be an incident to visit (following up for a problem the physician has already diagnosed and begun treating), but the patient has an additional problem that also needs attention (and the additional problem is new) can the visit still be billed as incident to?

No it cannot be an incident to encourage niter if any part of the encounter is not strictly followup. So a new problem or new or changed plan of care would negate being able to call the encounter incident to
 
Incident to

If a new complaint is addressed during the visit, it is no longer Incident To. Bill under the Midlevels NPI # as the visit is no longer following the initial MDs POC.
