Wiki Incident to billing - provide the E/M

In billing incident to, CMS requires that the Provider actually meets the patient on the initial visit with the PA and any F/U the patient can see the PA with the provider in the office but not actually in the room with the patient, my question is, do the commercial payers require the Provide to meet them on the 1st visit or is it exceptable for the PA to provide the E/M while the provide be near by in the office but not in the actual room?
