Wiki EMR/EHR loophole?

My Physicians wife has come to me asking me to research loopholes of anyone that DOES NOT have to opperate with an Electronic Record, in other words they are wanting to go back to paper charts. Does anyone have a link as to where I can find something showing them in black and white there is no way around having an EHR/EMR? I have looked on cms and other sites but nothing showing what I need so they can understand.

I haven't seen any requirement anywhere stating that physicians/facilities MUST switch to EHR. But are you referring to avoiding CMS's penalty? Or just in practice in general?
 
I think that's correct - there is no mandate that forces providers to use an EHR, but the Medicare penalties for not having one are gradually increasing (last I heard it is supposed to eventually go up to 5%). There are some ways to request a hardship exemption from having to pay the penalty, but these are pretty limited. Here's a link with more information:
