Wiki emergency surgery opt out medicare provider

Submitted claim for opt out Medicare provider using GJ modifer but still denied and upheld on level 1 reconsideration., MD say pt as an emergency did surgery and then took over the post op care.
Is another modifier necessary? Not sure why claim continues to be denied.
