Is it appropriate to choose an E/M level based on counseling time which was extended due to use of a language interpreter? We have a family practice which sees a lot of immigrants with limited English proficiency. Because they're using interpreters, they're only seeing about half the number of patients than other practices in the area which do not have the same patient demographics. Can a higher level E/M be chosen in these circumstances? I'm getting conflicting information.
 
The use of an interpreter does not count as counseling and coordination of care. If billing based on counseling and coordination of care the percentage of time spent must counseling and/or coordinating care has to be documented along with a description of the counseling and/or activities to coordinate care. You may be able to use one of the prolonged services codes.
