No there is no modifier you bill the level of care supported by the documentation and that will be the maximum reimbursement.

Critical Care
You never code to get maximum reimbursement. You code based on the service documented. If they think they are doing "more," then they should document "more."
Your trauma surgeons should be aware, for example, that if they have a critically injured patient for whom they provide critical care for 30 minutes or more, they can use the 99291-99292 critical care codes. IF ... Big, Red, IF ... they have appropriately documented that care.
