Wiki discontinued procedure

The situation is a patient comes to ED, found to have bilaterial TMJ dislocations - patient was sedated and procedure started - pt then began trying to bite during procedure and the procedure was stopped. Can we bill for procedure with 53 modifier? The reason for stopping procedure was not life threatening.

Modifier 53- due to extenuating circumstances or those that threaten the well being of the patient, sounds about right, I hope the MD documented all the information.
