Wiki Consult billing question done in er

My question I have is that my doctor seen a patient in the ER for consultation and the reason for consult was lung cancer but the patient expired before being formally admitted but the dr dictated that he spent 40 total bedside time with patient. My question how would this be billed?

I think you would have to bill one of the Emergency Dept E&M cpts. 99281-99285
