We have some internal disagreements about how to interpret the "14 Day Rule" exception to the CMS Laboratory Date of Service Policy. The way the policy is currently written on the CMS website (link below), it appears to apply to any lab test on a specimen that was collected during a "hospital" visit. However, because this rule was initially formulated for chemosensitivity testing for tumor samples, we have some question about whether the 14 day rule ONLY applies to chemosentitivity testing, and that for other testing (except Molecular/ADLT testing) on a specimen collected during a hospital encounter, the date of service has to be the date of collection.
Looking at the CMS Claims Processing Manual (section 40.8), it appears to apply the 14-Day Rule separately to any testing on a specimen collected during a hospital encounter, not just chemosensitivity testing. Is that how others are interpreting this Date of Service Policy?
