In an audit finding, Are there leagal obligations to correct the claim when something is wrong. Whether it be coded at a higher level, lower level or procedure not documented correctly?
Or is it something that is written in the companies compliance plan as to what will be done if a discrepency was found?
They can choose not to repay an overpayment?

CMS requires repayment within 60 days or it is considered a false claim.

In addition, its a good idea to have it in your compliance plan that any claims found in error will be submitted correctly and overpayments will be refunded.
