If a practice is working without sufficient supervising physicians leaving residents to provide mental health care without the required supervision, would it be appropriate to use an ABN so that charges could be passed on to the Medicare beneficiary instead of being written off?

You cannot charge the patient for services that were insufficiently supervised. I suggest you immediately reach out to your compliance department. This seems less like a coding issue and much more like a legal one.
 
Agree, you cannot charge a patient for a service which is noncompliant. This is a service that would need to be written off and absolutely not passed on to the patient or their insurance.
