CPT Assistant June 2008 page 12 seems to categorize 99358 as an inpatient setting code rather than an outpatient setting code. Can 99358 be used in the outpatient setting? Also, the same source states that the primary service and 99358 must occur on the same date of service, but the this appears to be for the inpatient setting. Is this also true (same DOS) for the outpatient setting?

I had the same impression from several similar articles. However, reviewing this article and chapter 12 of cms handbook, use of this code is appropriate in the outpatient setting.

99358 was an add on code until 2010 when the add on status was removed. It is for physician use for non face to face prolonged time, and must be a min of 30 minutes to be reported. It is not designated as inpatient or outpatient, it can be either.
