Wiki 99307 and mid-levels

Wanted to check on something I have no idea about.

Skilled nursing facilities and nursing homes.

Hypothetically, a practice has mid-levels go to a nursing home and see patients after the initial visit and plan of care has been established (basically an "incident to" visit).

The practice is billing 99307 with the mid-level as the performing provider and their physician as the billing provider even though he is not there and did nothing. From everything I've read, you can't do that unless there was a "designated office area" and then you wouldn't be charging the 99307 you would be charging regular OV e/m codes like 99213.

Am I right about this?
