Wiki 3 year rule

A patient was seen in our facility a little over 3 years ago. Pt comes back just over the 3 year mark, and the nurse practitioner that treated the pt, dictated that this was a follow up visit. Can we bill a new patient E/M code??

If it has been over three years they are considered a new pt.
