OIG Adds Two-Midnight Rule to Work Plan

If you thought your short-stay inpatient claims were good to go, you’d be wrong. In a stunning turnaround from its previous decision to steer clear of scrutinizing the Centers for Medicare & Medicaid Services (CMS) Two-Midnight Rule, the HHS Office of Inspector General (OIG) has now decided to re-up its audits of the confusing policy.

Breakdown: Claiming past issues with overpayments, the federal watchdog added the perennially bewildering claims to its Work Plan. “While OIG previously stated that it would not audit short stays after October 1, 2013, this serves as notification that the OIG will begin auditing short stay claims again, and when appropriate, recommend overpayment collections,” explains the agency.

Despite revisions to the Two-Midnight Rule and its promise to stop auditing short hospital stays, OIG plans to home in on the claims as well as review hospital administrators and Medicare Administrative Contractors (MACs) policies and procedures to ensure compliance.
