Medicare Compliance & Reimbursement

Industry Note:

Register These CMP Adjustments

Whether your practice compliance is topnotch or needs an overhaul, it’s a good idea to know what the costs are for noncompliance.

Context: The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 governs inflation increases and mandates agencies like the Department of Health & Human Services (HHS) update their civil monetary penalties (CMPs) annually. On Nov. 5, HHS published its CMP adjustments in the Federal Register.

The rule lists all CMP changes that fall under HHS jurisdiction. The regulations impacted include the False Claims Act (FCA), Physician Self-Referral Law (Stark Law), the Anti-Kickback Statute (AKS), HIPAA, the Civil Monetary Penalty Law (CMPL), and others.

The rule went into effect on Nov. 5.
