ENFORCEMENT WATCH:

Bogus Diagnosis Scam May Send Physician Up River

Medicare nabs doc who treated nonexistent skin cancer ... repeatedly.

Health care fraud goes deeper than billing for fictional procedures - sometimes the diagnoses are made up as well.

No Fun In The Sun For These Misled Patients

Sarasota, FL dermatologist Michael A. Rosin was arrested for 25 counts of health care fraud and 25 counts of making false statements in health care matters, according to an April 11 Department of Justice press release.

Charge: Rosin allegedly falsely diagnosed patients with cancer, mostly basal cell carcinoma.

After the phony diagnosis, the dermatologist purportedly conducted biopsies on patients, performed medically unnecessary surgeries based on false cancer diagnoses and fraudulently billed Medicare for the procedures. Rosin misdiagnosed cancer from biopsy slides with no identifiable human tissue, the DOJ alleges.

Prison Pending? Perhaps

Rosin could face up to five years imprisonment for each false statement charge and 10 years imprisonment for each health care fraud charge.

Lesson Learned: Misdiagnosing cancer for profit can earn physicians serious prison time.
