Heed These Smoking-Related Immediate Jeopardy Cases

Beware these potential problems.

Nurse attorney Janet Feldkamp reports having handled four or five IJ cases involving smoking over the years. "Typically these involved unsupervised outdoor smoking," she says. In one case, the person could smoke independently, "but a wind-related issue started the person's jacket on fire as they were smoking," adds Feldkamp, with Benesch, Friedlander, Coplan & Aronoff LLP, in Columbus, Ohio.

Feldkamp says she also encountered "some indoor issues, as well, where people who should have been supervised weren't in situations when the staff person left their post."
