Tenn. Provider Socked With Wage & Hour Back Pay

You'd better watch how you're paying your home health aides, or you could end up owing tens of thousands of dollars in back pay like one Memphis home care provider.

Taylor Brown Gardens Healthcare has agreed to pay $66,694 to 17 employees and to correct recordkeeping violations following a Department of Labor investigation that identified violations of the Fair Labor Standards Act, the DOL says in a press release. The company is paying $54,152 in back wages and $12,542 in overtime back wages.

Investigators from the DOL's Wage and Hour Division found that Taylor Brown paid employees a daily flat rate that didn't meet minimum wage requirements. And some employees were not paid overtime for hours worked in excess of 40 in a week. The company has created a daily timesheet to track employees' work hours and has posted required notices to inform employees of their rights, the DOL says.
