A Philadelphia company that furnishes staff including personal care assistants, home health aides and licensed practical nurses will pay $9.3 million in back wages and damages, the Department of Labor says in a release. A DOL Wage and House investigation found U.S. Medical Staffing Inc. misclassified employees and failed to pay them overtime wages for hours worked over 40 per week, the DOL notes. The investigation was complaint-driven.
“Too often we find workers denied wage protections, such as the right to overtime pay and other benefits, by employers who misclassify them as independent contractors,” says Wage and Hour Principal Deputy Administrator Jessica Looman in the release. “The Wage and Hour Division will hold employers accountable when they misclassify employees to cut labor costs and gain an unfair advantage over the competition.”
