A federal court has ordered a Philadelphia home care agency and its owner to pay about $1.6 million in back wages and liquidated damages to 288 workers deliberately denied overtime pay. The consent judgement covers $823,265 in back wages and an equal amount in liquidated damages, plus a $56,218 civil money penalty assessed by the Department of Labor Wage and Hour Division “for the willful nature of the employers’ violations of the Fair Labor Standards Act,” the DOL says in a release. Aging with Care Inc. and owner Amber Haq failed to pay overtime when required; to combine hours for different clients; to pay for travel time; to maintain full and accurate documentation; and to keep required payroll records, the DOL says. “This case highlights the impact of the work we are doing in the home care industry to make sure workers are compensated fairly and employers comply with the law,” WHD’s Mark Watson says in the release.
