Don’t be surprised to see the so-called 80/20 rule for Medicaid come out any time now. Recent remarks from both President Biden and HHS Secretary Xavier Becerra have alluded to the rule's imminent release. For example: “In the coming weeks, we plan to release new rules … to get homecare workers a bigger share of Medicaid payments,” Biden said in an April 9 speech at Union Station in D.C. “While well intentioned, the rule does not account for the various regulatory and statutory requirements associated with delivering these services, such as nurse supervision, electronic visit verification, travel mileage reimbursement, or other necessary expenses,” the National Association for Home Care & Hospice rebuts in its member newsletter. The Office of Management and Budget concluded its review of the Ensuring Access to Medicaid Services (CMS-2442) rule on April 15, it reports on its website. This is “the final clearance step before rules are released,” NAHC notes. “The Final Rule is expected before the end of April,” the trade group adds.
