HHA Fraud Nets Jail Time

Participants involved in a home care scam are facing years of jail time. Miami-area physician Jose Nunez was sentenced to 40 months in prison and $1.1 million in restitution, according to a release from Assistant Attorney General Lanny A. Breuer. In August, Nunez pled guilty to prescribing medically unnecessary services, including home health and therapy, care plans and medical certifications, from January 2006 until March 2009, in exchange for kickbacks and bribes from ABC Home Health and Florida Home Health Care Providers Inc. in Miami (see Eli's HCW, Vol. XX, No. 31, p. 246).

RN Luisa Morciego will serve 24 months in prison and pay $296,000 in restitution. Morciego admitted to falsifying patient records in the scheme (see Eli's HCW, Vol. XX, No. 28, p. 218). And LPN Eneida Fry will serve 24 months and pay $395,000 in restitution for falsifying patient records and recruiting beneficiaries in exchange for kickbacks and bribes, the release says.
