Department Of Labor Signals Plan To Appeal Companionship Exemption Ruling

You can pay your employees using the companionship exemption for overtime, but keep an eye on court proceedings to see how long that may last.
The Department of Labor says it will appeal the federal court decision that restored the companionship exemption to Fair Labor Stan-dards Act minimum wage and overtime rules (see Eli’s HCW, Vol. XXIV, No. 3). It will also appeal the ruling that said third-party employers such as home health agencies are allowed to use the exemption, according to press reports.
