The lawsuit regarding the Department of Labor’s elimination of the companionship exemption for home health agency workers is moving forward. One of the plaintiffs in the case, the Home Care Association of America, has told its members it will ask the D.C. Court of Appeals to extend the automatic stay on the court’s ruling upholding DOL’s Home Care Rule beyond Oct. 13, 2015, reports law firm Gilliland Maguire & Harper. This will give the trade group for private duty agencies “time to prepare a request for review of the ruling by the U.S. Supreme Court,” GMH notes.
Another plaintiff, the National Association for Home Care & Hospice, “has committed to pursue further appeals, including through the U.S. Supreme Court,” it says in its member newsletter. “Efforts are underway to expedite such action and to garner support from other interested parties.”
