Claims for outpatient therapy provided in the home under Part B are starting to process with the therapy cap in place. The Centers for Medicare & Medicaid Services said earlier it was holding the claims in light of a potential legislative development in the matter (see Eli's HCW, Vol. XXVII, No. 5). Now CMS says it "is immediately releasing for processing held therapy claims with the KX modifier with dates of receipt beginning January 1-10," according to a Jan. 26 message to providers. But "CMS will also implement a 'rolling hold' to minimize impact if legislation to extend the outpatient therapy caps exceptions process is enacted." Remember: The therapy caps apply only to outpatient therapy furnished under Part B, not to therapy services furnished under the home health benefit.
