NYC Aides Win OT Suit

The battle over the federal "companionship exemption" to overtime laws continues, but that may not matter if you're in a state with stricter state laws on the matter.For example: Workers for McMillan Home Care Agency in New York City have won a $1.1 million settlement in a class action lawsuit over overtime wages, according to a release. About 1,500 members of the class will share in the settlement."New York has its own state labor law like most states do," Catherine Ruckelshaus from the National Employment Law Project told WNYC. "And under New York law, these home care workers are covered and they do need to be paid the minimum wage and overtime."Lawyers for workers say it's the first time home health aides have been certified as a class in New York State, WNYC reports.
