NAHC Readies Lawsuit Against Pre-Claim Review

Buckle up for a bumpy ride.

Illinois home health agencies continue to stagger under the burden of Pre-Claim Review as Medicare and its contractors prep for rolling out the demonstration program to more states.

But the National Association for Home Care & Hospice hopes to put a stop to the unreasonable demo before that happens. The NAHC Board of Directors has authorized a lawsuit against the Centers for Medicare & Medicaid Services over PCR, the trade group says. At press time, the suit hadn’t been filed yet, NAHC’s VP for Law William Dombi told Eli.

Filing a lawsuit is the “last resort” for NAHC, said Val Halamandaris at the trade group’s annual meeting in Orlando last month. “CMS has left them with no alternative,” according to NAHC’s member newsletter. “Backed into a corner by unfair and capricious regulations, Halamandaris vowed NAHC will fight back.”

But agencies can’t expect any quick fixes. “This will be a grueling case,” Dombi said at the meeting. To succeed, the case must show harm to patients, not just providers.
