Exception Process For Therapy Caps Signed Into Law

An extension to therapy cap exceptions until Dec. 31 is now law. Part of the Middle Class Tax Relief and Job Creation Act of 2012 containing the so-called "doc fix" extended the therapy cap exceptions process. President Obama signed the legislation into law Feb. 22. Home health agencies furnishing Part B outpatient therapy in the home must "submit the KX modifier on their therapy claims, when an exception to the cap is requested for medically necessary services furnished through December 31, 2012," CMS reminds providers. The caps do not apply to therapy furnished under a home health plan of care.
