Industry Note:

Comply With New HIPAA Requirements Now In Effect

Is your HIPAA paperwork up to date? If not, you could be in trouble under the new HIPAA requirements that took effect Sept. 23 (see Eli’s HCW, Vol. XXII, No. 33).

Be sure your privacy notices include new requirements such as a statement letting patients know they can revoke prior authorizations, advises the National Association for Home Care & Hos-pice in its member newsletter. A sample notice from the HHS Office for Civil Rights is at www.hhs. gov/ocr/privacy/hipaa/modelnotices.html.

Your agreements with new Business Asso-ciates also must include new elements such as a provision requiring destruction of PHI upon contract termination, NAHC notes. However, you have another year to bring your existing BA agreements into compliance with the new HIPAA rules, the trade group adds. A sample agreement from the OCR is at www.hhs.gov/ocr/privacy/hipaa/understanding/
coveredentities/contractprov.html.
