Companionship Exemption Case Stalls At Supreme Court

The vacancy on the U.S. Supreme Court is not good news for home care providers. The ninth seat on the Supreme Court has been vacant since Justice Antonin Scalia’s death in February, and a replacement is unlikely any time soon since Congress is blocking consideration of a new nominee until after the presidential election in November.

The Court may be avoiding cases in which the justices expect a 4-4 tie, which leaves the situation status quo, reports The Hill newspaper. The Court hasn’t put the Home Care Association of America v. Weil case, which address elimination of the companionship exemption, on its schedule yet, the paper notes.
